1.0 Definitions
In this agreement the following definitions apply.
1.1. Together Recruit & TogetherRecruit.co.uk means Together Recruit Ltd, International House, 61 Mosley Street, Manchester. M2 3HZ.
1.2. Client means the person, firm or corporate body together with any subsidiary or associated Company as defined by the Companies Act 1985 to which the applicant is introduced.
1.3. Applicant & Candidate means the person who has applied for a vacancy through any job board advertising or e-mail or online site associated with Together Recruit Ltd.
1.4. Vacancy means the role that has been described by the client and agreed with Together Recruit Ltd.
1.5. Job Board & Job Boards means the websites, social media sites and any other advertising medium that Together Recruit Ltd deems appropriate to advertise the Clients vacancy.
1.6. ATS means Application Tracking System, an online portal provided by Together Recruit Ltd which is used to advertise and track Client vacancies and as a system for applicants and candidates to upload personal details and curriculum vitae.
1.7. User & Users means a person acting on behalf of a Client and is authorised by the Client to use the ATS account.
1.8. Solutions & Products means the services offered by Together Recruit Ltd.
1.9. Price & Prices means the amount charged by Together Recruit Ltd to the Client for the agreed product or solution.
1.10. Campaign & Campaigns means the advertised role and duration as described by the Client and agreed with Together Recruit Ltd.
1.10. No variation or alteration to these terms and conditions shall be binding unless agreed in writing between an authorised representative of the Client and the Director(s) of Together Recruit Ltd.
1.11. By using our services, you have deemed to have accepted these terms and conditions.
2.0 Fees and Notifications.
2.1. All fees will be agreed in advance and are payable to Together Recruit Ltd by the Client which will be provided as part of any advert sign off or agreed services.
2.2. Together Recruit Ltd will only proceed once the terms and conditions and order confirmation have been accepted by the Client.
2.3. Invoices are presented to the Client once an order confirmation has been agreed and their vacancy goes live.
2.4. Invoices are payable within 30 days of the issue date and are subject to credit status. Should Together Recruit Ltd acknowledge you do not meet our approval criteria we may ask for an upfront alternative payment method of the full invoice value before Together Recruit Ltd proceed.
2.5. Any invoice that is unpaid after 31 days of the invoice date could result in the suspension of the advert and any additional adverts that proceed this invoice date until this invoice is paid in full and cleared at the Together Recruit Ltd.'s nominated Bank.
2.6. Together Recruit Ltd reserve the right to charge 4% interest under the Late Payment of Commercial Debts (Interest) Act 1998 accruing daily.
2.7. Together Recruit Ltd fees are non-refundable unless we have been found to be in material breach of these terms and conditions.
2.8. The Client can recruit as many people they need per vacancy or campaign if those recruited are initially employed as per the requirements of the vacancy within the campaign.
2.9. Together Recruit Ltd will not charge for any placements fees as a result of the success of any campaign.
3.0. Services provided by Together Recruit Ltd.
3.1. Together Recruit cannot guarantee a particular level of success to a vacancy or held responsible for any future failure of a successfully employed candidate through the services employed from Together Recruit Ltd by the Client.
3.2. Together Recruit Ltd will provide their services with all reasonable care and skill.
3.3. Together Recruit Ltd will provide a draft advert which will be compliant with laws and legislations for approval by the Client. The advert will remain the property of Together Recruit Ltd. Once approved Together Recruit Ltd will distribute the advert across appropriate Job Boards.
3.4. Clients may be provided with an ATS account appropriate for agreed use which will include visibility and review as a minimum.
3.5. Together Recruit Ltd will make appropriate contact with the Client or authorised representatives as agreed by the purchased product in terms of introduction, review, and advert / candidate monitoring.
3.6. Campaigns will be managed appropriately as set out in the product descriptions on the Together Recruit Ltd website.
3.7. Multi-buy purchases and job board credits must be paid in full as detailed in payment terms (2.4). Unused job board credits are non-refundable as detailed in refund terms (2.7). Job Board credits must be used within 12 months of the purchase date or the date agreed in the sales invoice on completion of purchase.
3.8. 'We guarantee you won't find the same package cheaper, if you do, we will advertise your next campaign for free'. To qualify, the same deal must be equal to what is being offered by Together Recruit, it should not be part of an introductory offer, multibuy promotion or new customer incentive, it must be available at the time of the request and is limited to one job posting to a maximum of £99.00. No cash alternative will be made.
4.0. Liability.
4.1. Together Recruit Ltd cannot accept responsibility for any loss, delay or damage caused by a candidate who has been employed through the services it offers. It is the responsibility of the client to take up references, obtain work permits, confirm medical requirements and or professional qualifications where required.
4.2. Together Recruit Ltd liability to the Client shall not exceed the price agreed of the associated product or solution at the time of purchase.
4.3. Together Recruit Ltd will not be liable as a result of any third-party failure in terms of communication, website or social media.
4.4. Together Recruit Ltd will not able liable for any inaccurate statements or wording once a job advert agreed by the Client which is live on Job Boards or social media. Together Recruit Ltd will consider rectifying and inaccurate statements or wording as it feels appropriate or as provided by the Client.
5.0. Applicants and Candidates.
5.1. Applicant and Candidate information that is provided to the Client is done so in the understanding that it is in confidence and must not be passed to a Third Party.
5.2. Together Recruit Ltd will hold applicant data within their nominated Third-Party site which will be held in accordance with Data protection laws. Third Party details are available on request to Client or Candidate.
5.3. Together Recruit Ltd will not be responsible for the content of an applicant or candidates C.V, their answers, conduct, criminal records and eligibility to work in the UK.
6.0. References.
6.1. Together Recruit Ltd will not take up formal references on behalf of a Client and will not be responsible for taking up references.
7.0. Complaints.
7.1. In the unlikely event that you should have a complaint about Together Recruit Ltd, please direct in the first instance to us at Support@TogetherRecruit.co.uk or call us on 0330 223 5153.
8.0. Termination.
We may terminate a job advert and your account at any time and without notice at our discretion if:
8.1. You are found to be misusing the service, acting illegally or in any way to damage the name, reputation or service of Together Recruitment Ltd and/or its employees.
8.2. You are in breach of these terms and conditions for a period of more than 7 consecutive days after you have received notice to rectify from Together Recruit Ltd.
